Recent FAA Guidance and Directives Concerning Grant Assurance Compliance and Federally Funded Projects
This topic will provide participants with an update regarding recent FAA Guidance on AIP Contract Terms, PFC eligibility for rail projects, new ADA compliance requirements, new use restrictions compliance policy and other recent developments. Download Handout
Presenters: Scott Knight, Tampa International Airport; Peter Kirsch, Kaplan Kirsch & Rockwell LLP; and Debra Braga, Jacksonville International Airport
Scott Knight has been an Assistant General Counsel with Tampa International Airport since June 2008. As part of a 3 attorney department, he focuses on all legal aspects affecting Tampa International, but his primary areas of practice include procurement, sunshine law/public records, real estate, operations, governmental and legislative affairs, general aviation, concessions and police.
Prior to joining Tampa International, Mr. Knight was in private practice for 9+ years, concentrating on construction litigation and surety bonding.
Mr. Knight currently sits as Vice-Chairman for the Florida Airports Council Legal Committee, and is also active in the ACI-NA Legal Affairs Committee.
He is admitted to practice in all courts in Florida. He is a graduate of Florida State University and the University of Florida College of Law.
Debra Braga is a graduate of the University of California, San Diego, and the University of San Diego Law School. She started practicing law in 1984, and is a member of the state bars of Alaska and Florida. A San Diego native, she accepted an internship assignment in Alaska her last semester of law school, and ended up staying for eight years.
Seeking a warmer climate, she moved to Florida in 1990. Working for the City of Orlando, she had the great experience working with the Greater Orlando Aviation Authority on projects, and she started her hands-on experience with airports in 2002 while working as the City Attorney for the city of Fernandina Beach.
In 2007, she began working for the City of Jacksonville, and represented various clients as part of the City’s Office of General Counsel, primarily the local utility and the Jacksonville Aviation Authority. Her representation of the JAA became full time in 2011. The JAA is a system of four airports, and as the Chief Legal Officer for the Authority, she handles all the day to day legal matters, including negotiating and drafting lease and concession agreements, handling human resource and procurement issues, and assisting with general aviation questions and operational issues.
Peter J. Kirsch is a partner with the law firm of Kaplan Kirsch & Rockwell, with offices in Denver, Colorado and Washington, DC. His practice emphasizes regulatory, environmental, and land use law for transportation and other large infrastructure projects.
For more than 25 years, Mr. Kirsch has concentrated his practice on airport development and regulatory issues. He regularly advises airports and local governments on land use law, federal legislation and regulations, and airport financial issues. He has represented clients in precedent-setting litigation relating to the powers of airport sponsors, control of airport noise, and preventing encroachment of incompatible land uses. He has been involved in the development of most of the new commercial airports in the United States in the last quarter century, as well as dozens of airport expansions, redevelopment projects, airport collateral land projects, and airport lease negotiations. He regularly advises airport governing bodies on the scope of their authority and legal obligations to the federal government.
Mr. Kirsch is a frequent speaker at professional conferences on airport development and operational issues in the United States and elsewhere. He is admitted to practice in the District of Columbia, Colorado, Maryland, and Washington State, as well as many federal district and appellate courts and the U.S. Supreme Court. He is a graduate of Oberlin College and the University of Chicago Law School.
